One person was suffering from Kidney disease and the Doctor at prestigious tertiary care super speciality hospital of New Delhi "Sir Gangaram Hospital" prescribed Ketosteril for this but Pharmacist could not read it very well and gave analgesic Ketoprol Dt resulting in Death of patient.therefore her wife from Maharashtra filed a consumer court case in Delhi state against Hospital as negligence of service
But Delhi state commission didnot consider this case in consumer court as here excess money is not charge but The National Consumer Disputes Redressal Commission (NCDRC) has directed the Delhi State Commission to reconsider a case of alleged medical negligence by Sir Ganga Ram Hospital that led to the death of a patient.
The direction came while the apex consumer forum was hearing a revision plea moved by the complainant against the order of the State Consumer Disputes Redressal Commission.“We do not agree with the State Commission’s observation that this is not a consumer dispute. In our view, this is a case of alleged medical negligence [resulting in death], alleged deficiency in service,” the NCDRC said.
It had been alleged by complainant Vimla, that due to alleged medical negligence by the hospital, her husband had died. It was alleged that a wrong medicine was administered to the patient, which led to his death.However, the State consumer forum had held that the case was not a “consumer” one and had to be sent for trial.
“The whole controversy in the case hinges on the point whether illegible writing of the doctor resulted in pharmacist issuing him medicine contrary to the one prescribed.On careful consideration of the matter, it is noticed that this is not a consumer dispute,” the State commission held.
Setting aside the order passed by the State commission, the NCDRC has directed the parties to appear before the State commission in Nov.So not againa bad handwriting has cause death of a patient and prestige of such super speciality Hospital at stake.
