DNB AND MD/MS ARE EQUIVALENT-DELHI HC ALLOWS DNB TOBE ASSISTTANT PROFESSOR AT AIIMS OVERRULING CAT COURT ORDER AGAINST IT

 DNB in PG is equivalent to MD/MS has been established by Delhi High Court .The Delhi HC stayed the Central Administrative Tribunal order (CAT) that put aside the appointment of a physician as Assistant Professor of Health center Management at AIIMS, announcing she didn’t possess the needful qualification for the put up as she have only  03 yrs of DNB degree in that subject but didnot complete one year of more residency in a teaching institute iafter completion of 03 yrs of eduction.

                    As per MCI,a candidate of DNB will be considered equivalent to MD/MS for  teaching post in an institute if one completes 04 yrs of education after passing 03 yrs of DNB examination conducted by national Board of Examination and one year of residency in that subject in a teaching Institute.Same applied for PG Super Speciality but Health Ministry in a recent order said that both DNB and MD/MS are equivalent in all aspect,and it is more so if a candidate passes DNB from a teaching institute or a hospital having more than 500 beds but few members of present Board of Governors of MCI opposed this decision of Health Ministry while working as members of Over Sight Committee appointed by Supreme Court to monitor old tainted MCI.Final decision regarding this has to be decided by these Board of Governors of new MCI.

                      Noting that the topic wanted some attention, the Delhi HC Bench of Justice Hima Kohli and Justice Rekha Palli, indexed the topic for January 2019, noting that until that point ” Until the following date of listening to, operation of the impugned judgment shall stay stayed.” Dr Kanika jain having only 03 yrs of DNB degree applied for the Assistant professor of Health Administation at AIIMS as per AIIMS performa,AIIMS accepted the form and appointed her but later 03 Doctors opposed her appointment at AIIMS on the ground that she didnot have one year of more experience as resident in that subject from a teaching institute.

                    So, CAT orderd  that the level of Diplomate of Nationwide Board (DNB) held by means of her used to be no longer enough and he or she had to go through an extra yr of residency in a health facility recognised by means of the Clinical Council of India (MCI).“It’s not in dispute that respondent three (Dr Kanika Jain) didn’t go through this kind of coaching or residency. The inescapable conclusion is that the choice and consequential appointment of doctor is vitiated and ordered AIIMS to cancel her appointment fillup this vacancy from remaining in selected list.

       Dr Jain, in her defence, had claimed that her DNB level used to be identical to an MD level and due to this fact, she used to be certified for the put up.She had additionally argued that AIIMS had decided on and appointed her to the put up after it used to be glad that she had the needful qualification.

             Such remarkable and timely Judgement by a High Court for the prestigious institute like AIIMS will pressurise present BOG of MCI ialong with Health Ministry to clarify it's view clearly so that in future any student doesnot face humiliation and harassment as faced by this candidate and till then all such appointment of DNB students without any residency will be considered valid in all teaching institutes too.
